FREQUENTLY ASKED U.S. TAX QUESTIONS FOR AMERICANS IN SPAIN
DO U.S. CITIZENS LIVING IN SPAIN STILL HAVE TO FILE U.S. TAX RETURNS?
Generally, U.S. citizens remain subject to U.S. federal income tax filing requirements even while living abroad. However, provisions such as the Foreign Tax Credit and Foreign Earned Income Exclusion may affect how income is ultimately taxed. The appropriate approach depends on your individual circumstances.
WILL I PAY TAX TWICE ON THE SAME INCOME?
Living in Spain can create tax obligations in both Spain and the United States, but mechanisms such as foreign tax credits and the U.S.-Spain income tax treaty may help address double taxation in many situations. Cross-border planning is important because the treatment can vary depending on the type and source of income.
DO I NEED TO FILE AN FBAR IF I HAVE BANK ACCOUNTS IN SPAIN?
U.S. persons with foreign financial accounts may have an FBAR filing requirement when the combined value of applicable foreign accounts exceeds the reporting threshold. Additional foreign financial asset reporting, including Form 8938, may also apply depending on the circumstances.
WHAT HAPPENS TO MY U.S. BUSINESS IF I MOVE TO SPAIN?
Moving to Spain does not automatically eliminate or change your U.S. business entity, but operating a U.S. corporation, S corporation, LLC or other business while living in Spain can introduce additional U.S. and Spanish tax considerations. Business owners should evaluate their structure before moving when possible and coordinate U.S. planning with qualified Spanish tax and legal professionals.
